By submitting a booking enquiry, paying a deposit, or proceeding with a photography session with DN Fotografie, the client confirms that they have read, understood and agreed to the following Terms & Conditions.
These Terms & Conditions apply to all photography services provided by DN Fotografie, including but not limited to portrait sessions, couple sessions, engagement sessions, matric farewell photography, family photography and wedding photography.
BOOKING & PAYMENT
A booking is only considered confirmed once the required 50% booking deposit has been received by DN Fotografie.
Submitting an enquiry or receiving a quotation does not secure or reserve a date.
The 50% booking deposit is required to secure the agreed date and time and is deducted from the total session fee.
The client may choose to pay the full session fee upfront. Where the full amount is paid, the payment will serve as confirmation of the booking.
The remaining 50% balance is due no later than the day of the scheduled photography session, unless another payment arrangement has been agreed to in writing.
DN Fotografie reserves the right to decline or release a booking if the required deposit has not been received.
Prices quoted are valid for the period stated in the quotation.
Any additional services, hours, locations, travel, products or extras requested after the booking has been confirmed may result in additional charges.
CANCELLATION & RESCHEDULING
The booking deposit is non-refundable where the client cancels their session, subject to any rights the client may have under applicable South African law.
The deposit compensates DN Fotografie for reserving the date and time exclusively for the client and for turning away other potential bookings for that period.
If the client needs to cancel or reschedule a session, they are required to provide at least 72 hours’ notice.
Where sufficient notice is provided, the client may request to reschedule their session to another available date, subject to DN Fotografie’s availability.
A rescheduled session must take place within 30 days of the original booking date unless otherwise agreed in writing.
Rescheduling is not guaranteed and is subject to availability.
Cancellations or rescheduling requests made with less than 72 hours’ notice may result in the booking deposit being forfeited and the session being treated as cancelled.
Failure to attend a scheduled session without prior notice will be treated as a cancellation, and the booking deposit will be retained.
If the client arrives late, the session will still end at the originally agreed time. The photographer is not responsible for extending the session due to client lateness.
PHOTOGRAPHIC STYLE & EDITING
The client acknowledges that they have viewed the photographer’s portfolio and are booking DN Fotografie based on the photographer’s established photographic and editing style.
The photographer retains creative discretion regarding composition, posing, lighting, image selection, colour grading, retouching and final editing.
The final gallery will reflect the photographer’s established editing style.
Requests for extensive or specialised editing that falls outside the photographer’s standard editing style may be subject to an additional fee and must be agreed upon in advance.
The photographer is not required to provide every photograph taken during a session.
The photographer will select and deliver the final images that they consider to be suitable for delivery.
RAW & UNEDITED IMAGES
RAW, unedited, rejected, duplicate or unfinished images are not included in any photography package unless specifically agreed upon in writing.
RAW files remain the property of DN Fotografie and will not be supplied to the client.
The photographer is not required to retain or archive RAW files indefinitely after the final images have been delivered.
PHOTOGRAPHER CANCELLATION
In the unlikely event that DN Fotografie is unable to provide the agreed services due to illness, emergency, injury, technical failure, circumstances beyond reasonable control, or another serious unforeseen circumstance, reasonable efforts will be made to provide a suitable replacement photographer or reschedule the session.
If the session cannot reasonably be rescheduled or an appropriate replacement cannot be provided, the client will be refunded amounts paid for the photography services that DN Fotografie is unable to provide.
DN Fotografie will not be liable for additional costs incurred by the client as a result of circumstances beyond the photographer’s reasonable control.
COPYRIGHT & OWNERSHIP
All photographs created by DN Fotografie remain the intellectual property and copyright of the photographer, unless otherwise agreed in writing.
The purchase of a photography session or digital images does not transfer copyright ownership to the client.
The client receives a personal, non-exclusive licence to download, print and share the delivered photographs for personal, non-commercial purposes.
The client may not sell, license, reproduce for commercial purposes, submit the images to third parties for commercial use, or otherwise exploit the photographs commercially without prior written permission from DN Fotografie.
ALTERATION OF PHOTOGRAPHS
The client agrees not to alter, edit, filter, crop, recolour, heavily retouch or otherwise modify photographs delivered by DN Fotografie.
This includes applying Instagram, TikTok, Lightroom, VSCO or other filters or presets to the photographs.
The reason for this is to protect the photographer’s artistic work and ensure that images attributed to DN Fotografie accurately represent the photographer’s editing style.
The client may crop an image where necessary for a social-media platform’s required dimensions, provided that the image is not otherwise altered.
SOCIAL MEDIA & PHOTOGRAPHER CREDIT
When sharing photographs online, the client agrees to credit DN Fotografie as the photographer and, where the platform allows, tag the photographer’s official social-media account.
The client is responsible for communicating these requirements to family members, friends or other persons who receive or share the photographs.
Where possible, the client should ensure that photographs are not altered before being shared online.
Failure by a third party to follow these requirements does not transfer copyright ownership or grant any additional rights to the photographs.
PHOTOGRAPHER’S PORTFOLIO & PROMOTIONAL USE
Unless the client requests otherwise in writing, the client grants DN Fotografie permission to use selected photographs from the session for the photographer’s portfolio, website, social media, advertising, marketing, competitions, exhibitions, publications and other self-promotional purposes.
This permission applies to photographs created as part of the client’s session and does not transfer copyright ownership.
If the client does not wish for their photographs to be used publicly, they must inform DN Fotografie in writing before or at the time of booking.
A request for privacy should preferably be communicated in the relevant enquiry form or by email so that it can be recorded with the booking.
CLIENT PRIVACY & IMAGE CONSENT
The client may request that their photographs not be used for public portfolio, social-media or promotional purposes.
Where a session includes other identifiable individuals, including family members, friends or children, the client is responsible for informing DN Fotografie of any relevant privacy concerns or restrictions communicated to them by those individuals or their legal guardians.
DN Fotografie will take reasonable steps to respect documented privacy requests.
GUESTS, FAMILY & ADDITIONAL PEOPLE
The client is responsible for ensuring that all persons participating in the session understand and comply with these Terms & Conditions where applicable.
The photographer may direct posing, positioning and movement during the session to achieve the best possible photographic result.
Additional people, locations, outfit changes or services outside the agreed package may affect the duration or price of the session.
VENUES & LOCATION FEES
The client is responsible for selecting and securing their chosen photography location or venue.
Any venue, entrance, permit, location or access fees are the responsibility of the client and are not included in the photography package unless specifically stated otherwise.
The client is responsible for obtaining any necessary permission to photograph at the chosen location.
DN Fotografie is not responsible for venue restrictions, closures, access limitations or changes imposed by a third-party venue.
TRAVEL FEES
Travel fees are not included in the standard photography package unless specifically stated otherwise.
Where travel outside the photographer’s base location is required, an additional travel fee will apply.
The client will receive a separate quotation for applicable travel costs based on the location of the session.
Additional costs such as accommodation, tolls, parking or other location-specific expenses may apply where relevant and will be communicated to the client in advance where reasonably possible.
DELIVERY OF PHOTOGRAPHS
Final edited photographs will be delivered through an online gallery or another digital delivery method selected by DN Fotografie.
The estimated delivery timeframe may vary depending on the type of session, season, workload and circumstances at the time of the booking.
The photographer will communicate any significant delays where reasonably possible.
The client is responsible for downloading and safely storing their photographs once the gallery has been delivered.
DN Fotografie cannot guarantee indefinite storage or availability of galleries after delivery.
IMAGE QUALITY & TECHNICAL LIMITATIONS
While DN Fotografie will make every reasonable effort to provide high-quality photographs, the photographer cannot guarantee specific images or outcomes where circumstances outside the photographer’s control affect the session.
This may include poor weather, insufficient lighting, venue restrictions, uncooperative subjects, guest interference, delays, unexpected events, technical limitations or other unforeseen circumstances.
The photographer will use professional judgement to work around such circumstances wherever reasonably possible.
CLIENT RESPONSIBILITY
The client is responsible for arriving on time, providing accurate booking information, communicating relevant requirements in advance and ensuring that all necessary permissions, venue bookings and location arrangements have been made.
The photographer cannot be held responsible for missed photographs or reduced coverage resulting from information that was not communicated before the session.
AGREEMENT TO THESE TERMS
By paying the booking deposit or proceeding with a photography session, the client confirms that they have had an opportunity to read and understand these Terms & Conditions and agrees to be bound by them.
The client acknowledges that these Terms & Conditions form part of the agreement between the client and DN Fotografie.
Any changes or exceptions to these Terms & Conditions must be agreed upon in writing by DN Fotografie.
DN Fotografie reserves the right to update these Terms & Conditions from time to time.
The Terms & Conditions applicable to a confirmed booking will be those accepted by the client at the time of booking, unless otherwise agreed in writing.
